Terms and Conditions – WineRelique.com

These are the Terms and Conditions governing the use of WineRelique.com (the “Site”). By using the Site, you agree to these Terms and Conditions. If you do not agree, please leave the Site immediately.

WineRelique encourages the legal and responsible consumption of alcoholic beverages.


1. Introduction

  • Zumedon Pty Ltd (ABN 72 606 939 655), trading as WineRelique.com (“WineRelique”, “we”, “our” or “us”), is an Australian private company limited by shares.

  • We operate an online marketplace platform via the Site, allowing consumers to purchase liquor and liquor accessories (“Products”).

  • WineRelique is the merchant of record for all sales on the Site. Customers contract directly with WineRelique.

  • Vendors and private collectors listing Products on the Site act solely as fulfilment agents of WineRelique. They do not sell directly to consumers, regardless of whether WineRelique or the Vendor/Collector manages freight.

  • All sales occur under WineRelique’s liquor licence. This allows private collectors with eligible stock to sell through the Site in full compliance with Australian liquor laws.


2. Definitions

  • Advertisement – A Product listing posted on the Site.

  • Agent / Vendor / Collector – A licensed liquor retailer or private collector engaged by WineRelique to warehouse, prepare, and dispatch Products on WineRelique’s behalf.

  • Australian Law – All laws, regulations, and requirements of the Commonwealth, States and Territories of Australia.

  • Business Day – A day that is not a Saturday, Sunday or public holiday in Melbourne, Australia.

  • Buyer – A consumer purchasing Products on the Site.

  • Catalogue – An electronic or printed document prepared by WineRelique listing Products.

  • Charge Back – A fee charged to a Vendor or Collector where WineRelique must reimburse a Buyer or a Buyer’s financial institution for a disputed or fraudulent transaction.

  • Commission – The percentage retained by WineRelique on each sale, currently 8.5% + GST unless otherwise agreed.

  • Eligible Delivery Address – An address where delivery of liquor is legally permitted.

  • Fulfilment Commission – The agreed percentage of the gross sale price payable by WineRelique to Vendors or Collectors for acting as fulfilment agents.

  • Intellectual Property Rights – All rights in copyright, trademarks, patents, designs, domain names, databases, and other proprietary works.

  • Licence – The irrevocable, royalty-free licence granted by Vendors/Collectors to WineRelique to use provided content.

  • Loss – Any financial or reputational loss, direct or indirect.

  • Merchant Fees – Costs charged by payment processors (e.g. banks, card networks).

  • Preferred Payment Method – Accepted payment methods (credit card, debit card, direct debit, BPay, Alipay, or others approved by WineRelique).

  • Product – Any item advertised and sold on the Site.


3. All Users

  • By using the Site, you agree that these Terms & Conditions and our Privacy Policy apply.

  • WineRelique facilitates transactions between Buyers and Vendors/Collectors, including customer service, chargebacks, fulfilment, warranties, returns, and claims in compliance with Australian Law.


4. Buyer Terms

  • Buyers must be 18 years or older and legally entitled to purchase alcohol. By ordering, Buyers warrant they are not purchasing on behalf of a minor.

  • Orders are offers to purchase. When accepted by WineRelique, a binding contract is formed between the Buyer and WineRelique.

  • WineRelique issues tax invoices, processes payment, and confirms orders.


5. Auctions

  • WineRelique may host auctions for certain Products.

  • Bids are binding offers to purchase subject to these Terms.

  • WineRelique reserves the right to refuse bids or withdraw Products at any time.

  • Vendors/Collectors and their associates may not engage in shill bidding.


6. Agency & Fulfilment

  1. Vendors and private collectors act only as fulfilment agents for WineRelique.

  2. All consumer payments, including for freight, are collected by WineRelique. Vendors/Collectors are not authorised to collect funds from customers.

  3. Freight may be arranged in two ways:

    • WineRelique-Managed Freight – WineRelique generates and pays for labels, Vendors/Collectors apply them.

    • Vendor/Collector-Managed Freight – Under a separate arrangement with WineRelique, Vendors/Collectors generate their own labels but still dispatch goods solely on WineRelique’s behalf.

  4. In all cases, WineRelique remains the merchant of record and Vendors/Collectors remain agents for fulfilment only.


7. Vendors & Collectors

  • Vendors must hold a valid liquor licence and provide details to WineRelique.

  • Private collectors must comply with WineRelique’s onboarding requirements and may only list stock under WineRelique’s liquor licence.

  • Vendors/Collectors warrant they have lawful title to all Products they fulfil.

  • Vendors/Collectors must comply with WineRelique’s fraud-prevention and fulfilment requirements.

  • WineRelique deducts Commission and applicable fees before remitting proceeds. Payments are made weekly, provided tracking is uploaded by Thursday close of business.


8. Shipping & Delivery

  • Delivery is subject to State and Territory liquor laws, including restrictions on “dry zones.”

  • Title and risk in Products pass to the Buyer upon delivery.

  • Vendors/Collectors remain responsible for secure packing and dispatch of Products as WineRelique’s agents.


9. Exchanges & Returns

  • No refunds for change of mind.

  • Faulty Products carry a 14-day replacement or refund warranty.

  • Claims must include proof of purchase and evidence of the fault.

  • Returns must be sent to WineRelique (or its nominated Vendor/Collector agent).


10. Fees & Payment

  • WineRelique may vary Commission and fees from time to time.

  • GST applies to Commission, freight, and insurance.

  • Vendors/Collectors grant WineRelique a perpetual licence to use content provided for listings and promotions.


11. Risk & Liability

  • Listings are accepted in good faith; WineRelique does not guarantee the accuracy of Vendor/Collector-supplied content.

  • To the extent permitted by law, WineRelique disclaims liability for indirect or consequential Loss.

  • Nothing in these Terms excludes statutory rights under the Australian Consumer Law.


12. Intellectual Property

  • The Site and its content are owned by WineRelique.

  • Vendors/Collectors grant WineRelique rights to use their content for advertising and fulfilment purposes.

  • Users may not copy, republish, or reverse-engineer Site content.


13. General

  • Currency: All transactions are processed in AUD.

  • Governing Law: These Terms are governed by the laws of Victoria, Australia.

  • Australian Consumer Law: Non-excludable rights apply.

  • Updates: WineRelique may amend these Terms; the version published at the time of use applies.
